These terms are the agreement between you and Beneficial Exchange Inc ("we"), which runs PeekQuiz. By using PeekQuiz, you agree to them. How we handle data is on the privacy page.
Who can use PeekQuiz
Anyone can take a quiz, but you must be 18 or older to give your email. To make an account or pay for a plan, you must be 18 or older, or the age of majority where you live if that's higher.
Your account
- You sign in with links sent to your email. Keep that email account secure, because anyone who can read it can sign in.
- Your handle (peekquiz.com/yourname) is permanent once picked. We may take back a handle that impersonates someone else or a brand.
- You're responsible for what happens in your account.
Your quizzes
- You own the words you write. You let us host, show and copy your quizzes, and make result cards from them, so PeekQuiz can work. That permission ends when you delete the quiz.
- You can use and change our templates for your own quizzes on any plan, including Free.
- On Free and Pro, quizzes and result cards show "Made with PeekQuiz". On Plus, they don't.
Rules for quizzes
Don't use PeekQuiz to make quizzes that:
- break the law, or someone else's copyright or trademark;
- harass, threaten or spread hate about people;
- contain sexual content, or are aimed at children under 13;
- pretend to be someone you're not;
- ask for passwords, payment details, health information, or ID numbers;
- promise prizes or results you won't deliver, or are scams or spam.
If a quiz breaks these rules, we may switch it off or close the account. When we can, we'll tell you first.
The emails your followers give you
Followers only give their email when they tick "Yes, [you] can email me". When you email them:
- only send the kind of emails you said you would in your quiz;
- include a working unsubscribe link and your contact details, and honor unsubscribes quickly;
- don't sell, rent or give the list to anyone else;
- delete someone's email if they ask you to.
Anti-spam laws (such as Canada's CASL, the US CAN-SPAM Act and the EU's GDPR) apply to the emails you send. You're responsible for following them. We hold the list for you and never email your followers ourselves.
Plans and billing
- Free costs nothing. Pro and Plus are paid monthly or yearly, in advance, and renew automatically until you cancel. Prices are in US dollars. Stripe may show and charge them in your local currency.
- Cancel any time on your Plan page. You keep your plan until the end of the period you've paid for, and you aren't charged again. Then you move to Free: your most recently edited live quiz stays on, the others switch off, and nothing is deleted.
- Refunds: we don't refund part-used months or years, or renewals you forgot to cancel. If you were charged by mistake (charged twice, charged after canceling, or charged the wrong amount), email hello@peekquiz.com within 7 days and we'll refund it. This doesn't affect any refund rights you have under the law.
- Price changes: if we change our prices, you keep the price you signed up at for as long as your subscription stays active.
- Limits: each plan's limits are on the pricing page. "Unlimited takers" on Plus covers normal use. If an account's traffic gets unusually large or looks automated, we'll contact you before changing anything.
- Free plan over its limit: your quiz keeps working. Emails past the monthly limit are saved but locked. Upgrading unlocks them. If you don't upgrade, they're deleted after 90 days (we email you at least a week before).
Ending your account
You can ask us to delete your account at any time by emailing hello@peekquiz.com from your account's address. We delete it, with all your quizzes and emails, within 30 days. On Pro or Plus, download your emails first if you want to keep them. We may close accounts that break these terms.
What we can and can't promise
We work hard to keep PeekQuiz running, but we provide it "as is". We can't promise it will never be down or never have bugs, and we can't promise any number of takers, shares, emails or sales. As far as the law allows, we aren't liable for indirect losses (like lost profits), and our total liability to you is limited to what you paid us in the 12 months before the problem, or US$100 if that's more.
The law that applies
These terms are governed by the laws of Ontario, Canada. If you're a consumer, you also keep any protections your local laws give you.
Changes
If we change these terms in a way that matters, we'll update the date and email creators at least 14 days before the change takes effect. If you don't agree, you can cancel before then.
